These terms are the agreement between you and NextStamp. Part A is for businesses that run loyalty cards on NextStamp: owners and the team members they invite. Part B is for customers who collect stamps. Our privacy notice explains what happens to personal data.
Who we are
NextStamp is run by Lentio Sechou, a sole trader in England, trading as NextStamp. You can reach us at hello.nextstamp@gmail.com. When these terms say "we" or "us", they mean NextStamp.
Part A: terms for businesses
Your account and your business
To run a business on NextStamp you need a NextStamp account and must be 18 or older. The person who creates a business is its owner and confirms they can agree to these terms for it. The owner invites the team and chooses each person’s role, and the business is responsible for what its team does on NextStamp. Keep your sign-ins to yourselves, give each person only the access they need, and remove people who leave.
The service
NextStamp gives you digital stamp cards, the till, till and window posters, optional tap tags, campaigns delivered on your customers’ cards, Insights, outlets and team access. Your customers can add their cards to Apple Wallet and Google Wallet. NextStamp doesn’t connect to your till system, card machine or booking system, and it doesn’t take payments from your customers.
We keep improving NextStamp and may change, add or remove features. Before a change takes away something you rely on, we’ll tell you in the app.
Plans, trial and fees
There are three plans: Free, Starter and Growth. Every plan has every feature and as many team members as you like. The plans differ in how many outlets and cards you can run and, on Free, how many customers can join. The limits and prices are on our pricing page and in Plan & billing, and prices include VAT where it applies.
- Trial. A new business gets 30 days with Growth’s limits, with no card needed. If you haven’t chosen a paid plan when it ends, your business moves to Free. Nothing is deleted: outlets and cards beyond Free’s limits keep working, but you can’t add more.
- Free’s customer limit. When a business on Free reaches 50 customers, new customers can still join for 14 more days. After that, new customers can’t join its cards until it chooses a paid plan or its count falls below 50. Customers already on its cards keep collecting stamps and using their rewards.
- Paying. Only the owner chooses or changes the plan. Payments go through Stripe, our payment provider, in advance for each month or year. Card details go to Stripe on its own pages, and we never see or store them. Invoices and receipts are on Stripe’s billing page, which you reach from Plan & billing.
- Choosing during the trial. Your trial carries on and Stripe takes the first payment when it ends. With less than 2 days of trial left, it takes the first payment straight away.
- Changing plan. A change of plan applies at once, and Stripe credits the unused part of the old plan on your next invoice. A change between monthly and yearly is charged at once, less the unused part of the old period. Extra outlets on Growth are added to your next invoice.
- Renewal and cancelling. A paid plan renews automatically at the end of each month or year until you cancel it on Stripe’s billing page. It then runs to the end of the period you’ve paid for, and your business moves to Free. Until then, Keep my plan in Plan & billing undoes the cancellation.
- Failed payments. If a payment fails, Stripe tries again and your plan carries on meanwhile, with a notice in the app. If every retry fails, the plan ends and your business moves to Free.
- Refunds. We don’t refund the unused part of a period when you cancel, or when you delete your business, which ends its plan at once. This doesn’t affect any rights you have by law.
- Price changes. We’ll tell you in the app at least 30 days before a new price applies to a plan you’re on. It applies from your first renewal after that notice, and you can cancel before then.
You use NextStamp for your business, so the consumer rules on cancelling contracts made at a distance don’t apply to your plan.
Your customers and your offer
The rewards, card terms, campaign gifts and deals are your business’s own offer to your customers, and you honour them. Write card terms that are clear and true, and make sure your rewards and promotions are lawful where you trade. Use your customers’ names and emails lawfully, within what they agreed to, and only for your own loyalty cards and offers.
Posters and tap tags stay where you put them. If you think someone has copied a poster’s code, replace the poster in the app.
Your customers’ data: we process it for you
For the customer details your business holds on NextStamp, your business is the controller and we are its processor. These processing terms apply under the UK GDPR:
- We process your customers’ data only to run NextStamp for you, as you set it up and use it. That is your instruction to us. If we think an instruction breaks data protection law, we’ll tell you.
- Everyone at NextStamp who can access it must keep it confidential.
- We protect it with measures that fit the risk, including encryption in transit, access only for the people who need it, and a record of every look an administrator takes at an account.
- We use the providers listed in our privacy notice. We’ll update that list before we add one, and if you object you can delete your business.
- We’ll help you answer your customers’ requests to see, correct or delete their data. Customers can also delete their own account at any time.
- If we become aware of a personal data breach affecting your customers, we’ll tell you without undue delay.
- When you delete your business, we delete its customers’ data, usually within minutes, as the delete screen explains. Stripe keeps the invoices you’ve already paid, which are our accounting records.
- We’ll give you the information you reasonably need to show that you and we meet these obligations.
Using NextStamp fairly
Don’t use NextStamp for unlawful rewards or offers, or for misleading card terms. Don’t try to get around the till’s approval, the tap tags’ signatures, our limits or another business’s data, and don’t scrape the service.
Suspending and closing a business
We can suspend or close a business that seriously or repeatedly breaks these terms or the law. A suspended business can’t give stamps, take new customers, receive till requests or run campaigns until we restore it. Suspension doesn’t cancel a paid plan by itself. If we close your business for any reason other than your breach of these terms, we’ll refund the unused part of your current period.
You can delete your business at any time from Settings, Delete business. That closes it at once, ends its plan and deletes everything it held.
Availability
We work to keep NextStamp running and secure, but we can’t promise it will always be available or free of faults. We may need to pause it for maintenance, and we’ll try to do that at quiet times.
Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law doesn’t allow us to limit.
Apart from that, we aren’t liable to a business for indirect or consequential loss, or for lost profits, revenue, goodwill or data. Our total liability to a business in any 12 months is limited to what it paid us for NextStamp in those 12 months.
Part B: terms for customers
Your NextStamp account
One NextStamp account holds your cards from every business. You must be 13 or older to have one. Keep your sign-in to yourself. You can delete your account at any time from Account, and our privacy notice explains what that deletes.
Cards and rewards
Each card is the business’s offer, under its own terms, which you see before you join. The business gives stamps and honours rewards, and NextStamp runs the card. A business can change a card’s rules, such as how many stamps you can collect per visit or per day, when it publishes a new version. Those limits apply to everyone at once, while the reward and terms you joined under stay with the round you’ve started. Questions about a reward go to the business that offers it.
Fair use
One account per person. Don’t copy poster codes, try to collect stamps without visiting, or collect stamps on someone else’s behalf. A business can refuse a stamp or a reward it thinks wasn’t earned.
Our responsibility to you
NextStamp is free for customers. We’re responsible for loss you suffer that was a foreseeable result of our breaking these terms or failing to use reasonable care. We aren’t responsible for a business’s offer, or for its decisions about stamps and rewards. Nothing in these terms affects your legal rights as a consumer.
For everyone
Changes to these terms
We’ll update these terms as NextStamp changes, and show the date at the top. If a change matters to you, we’ll tell you in the app before it applies. If you don’t agree with it, you can stop using NextStamp and delete your account or your business.
Law and courts
These terms are governed by the law of England and Wales, and the courts of England and Wales can hear any dispute about them. If you’re a consumer living in Scotland or Northern Ireland, you can also bring proceedings in your local courts.
